GENERAL RENTAL CONDITIONS (GRC)

1. PARTIES TO THE CONTRACT

This agreement is between EDLOCATION SARL Unipersonnelle, operating under the trade name TWID MOTO, headquartered at 50 Boulevard Stalingrad, 06300 Nice, France, SIREN: 984545145, VAT: FR94984545145 ("Lessor"), and the Lessee (individual or company), whose identity and contact information are specified in the rental agreement. By signing the rental agreement or validating a reservation online, the Lessee agrees to comply with all terms and accepts full financial and legal responsibility for the vehicle and accessories during the rental period.

2. VEHICLE & ACCESSORY PROVISION

Each rental includes: • One helmet and one pair of gloves • Anti-theft chain or lock • Phone holder The Lessee is responsible for using all included accessories correctly and safely. Failure to use the anti-theft device or failure to park in an authorized location (legal motorcycle parking spot, locked to a fixed metal object) results in full financial liability in case of theft or damage, even if insurance coverage has been selected. Optional extras (second helmet set, luggage box, delivery, fuel service, insurance, etc.) must be selected and paid for prior to the start of the rental.

3. RENTAL PERIOD & RETURN TERMS

• The rental period is defined in the rental agreement.
• Any request to extend the rental must be made at least 24 hours before the scheduled return.

4. CONDITIONS OF USE

• Vehicle is for personal use only.
• May only be operated by the Lessee or an authorized driver.
• Driving under the influence of alcohol or drugs is strictly prohibited. Use in competitions or off-road is prohibited. Parking must always be on legal motorcycle spots. Use of anti-theft device attached to a fixed metal object is mandatory when parked. Any failure to comply (improper parking, missing lock) = full financial liability in case of theft or damage.

5. DELIVERY & FUEL SERVICE (OPTIONAL)

• Delivery fees: Nice: €30 (each way), Monaco, airport, surrounding areas: €60 (each way).
• Fuel service: Vehicle may be returned empty if selected at booking. Fee: €25.
• Returning the vehicle with missing fuel without selecting this option: €50 penalty.
• TWID MOTO recommends wearing protective clothing and closed-toe shoes while riding. The Lessee assumes all risks from inadequate personal protection.
• The Lessee is fully responsible for the safety of any passengers and agrees not to carry more than one passenger unless otherwise authorized. The Lessor cannot be held liable for injuries or damages resulting from misuse or failure to follow local traffic laws.

6. SECURITY DEPOSIT

• A deposit is required prior to the rental: Amount: from €150 to €5000 depending on model and insurance.
• The deposit serves as security for the Lessor against any financial loss, damage, or contractual breach by the Lessee, including but not limited to the cost of repairs, replacement of the vehicle or accessories, unpaid rental fees, penalties, fines, towing, recovery, administrative charges, and any other amounts owed under this agreement.
• Important: The deposit does not limit liability. In case of total loss or theft, the Lessee is liable for the full replacement value of the vehicle - based on the invoice price of the vehicle at the time of purchase, minus standard depreciation as calculated by TWID MOTO's accounting policy.

7. LESSEE'S RESPONSIBILITIES & PENALTIES

Lessee agrees to:

• Drive responsibly.
• Protect vehicle from weather.
• Use and secure all equipment.
• Fines: full amount + €50 processing.
• Equipment replacement: Helmet: €200, Gloves: €50, Phone holder: €50, Helmet visor damaged: €50, Key: cost + €50 fee, Lock: €150, Flat tires: repair or replacement costs are fully chargeable to the Lessee, except in cases of proven manufacturing defect.
• TWID MOTO reserves right to refuse service or cancel booking for misuse, false documentation, or safety concerns.

8. INSURANCE, COVERAGE & LIABILITY

• Basic third-party civil liability is included.
• Optional insurance packages (only for 125cc and electric models): Smart Cover (€12/day): Deposit €400, liability capped at €400; Zero Cover (€20/day): Deposit €250, zero liability (excludes accessories); Total Cover (€24/day): Deposit €150, zero liability, accessories included.
• No insurance package available for 50cc scooters. Without insurance, all damage or theft is under full Lessee responsibility.
• Important: Any violation of rental conditions voids insurance coverage, and Lessee assumes full liability.

9. MILEAGE

• Unless otherwise stated, all rentals include unlimited mileage.
• In some cases, mileage may be limited and indicated in the rental contract.
• Additional kilometers will be charged €0.25/km.

10. PROCEDURE IN CASE OF ACCIDENT, THEFT, OR BREAKDOWN

11. RESERVATION, CANCELLATION AND EXTENSION CONDITIONS

• 24 hours or more before rental start: Free cancellation. Any prepaid amount will be refunded in full.
• Less than 24 hours before rental start: 30% of the total booking amount is non-refundable. The remaining amount (if prepaid) will be refunded.
• Any breach terminates coverage and transfers full responsibility to Lessee.
• TWID MOTO reserves right to refuse service or cancel booking for misuse, false documentation, or safety concerns.

12. PERSONAL DATA

TWID MOTO is not responsible for any personal belongings left in or on the vehicle. Lost items may be kept for up to 14 days before disposal.

13. MEDIATION AND DISPUTES

This contract is governed by French law. In the event of a dispute, the competent court shall be that of Nice, France. Prior to legal action, mediation may be initiated via CNPA/Mobilians: www.mobilians.fr

14. TERMINATION CLAUSE

TWID MOTO reserves the right to terminate the rental immediately and without refund in the following cases:

• Use of false or fraudulent identity or driving license.
• Breach of the GENERAL RENTAL CONDITIONS.
• Use of the vehicle for unlawful purposes, off-road use, or reckless driving.

In such cases, TWID MOTO may immediately recover the vehicle at the Lessee's expense. Recovery fee: €2/km from current location to TWID MOTO headquarters. Administrative fee: €100. All mechanical and cosmetic repair costs due to abusive use. Full deposit may be withheld.

15. IMAGE RIGHTS AND INFORMATION

• The rented vehicle is equipped with a GPS tracking device. The geolocation system is used exclusively for theft prevention and recovery, location in case of non-return, and monitoring compliance with the rental conditions.
• All geolocation data is processed in accordance with the General Data Protection Regulation (GDPR). The data is accessible only by TWID MOTO and will not be shared with third parties unless legally required.

16. GEOLOCATION SYSTEM

The use of the rented vehicle is restricted to a 50 km radius from the pick-up location unless otherwise authorized in writing by TWID MOTO.

• Travel to Monaco is explicitly permitted without prior approval.
• Any border crossing outside France (including to Italy) is strictly prohibited unless authorized in advance by TWID MOTO and subject to additional conditions or fees.
• Failure to respect these limitations will result in full liability for any incidents, void any insurance coverage, and may lead to immediate contract termination.

A condition report including photos will be established before and after the rental. Any new damage found upon return will be considered the Lessee's responsibility unless proven otherwise.
